With the increase in the demand for knowledge, colleges and universities are being forced to provide more and more courses. As a result, college tuition has increased significantly.
The average annual tuition at a four-year college in India is Rs 52,000. This is among the highest in the world. But many colleges and universities have to decide how much they should charge for such courses. The unfortunate situation of higher education in India is not new; it has been with us for quite some time now. In fact, for a long time, it was a significant source of income in the country.
Some went to school to get an education, and others thought about their future careers. For some, higher education has been a means of livelihood, and for others, it has been an opportunity to make money from their knowledge. But the truth is that today even educated people are taking jobs whose main objective is to provide a livelihood. . The problem with this trend is that it has given birth to many unscrupulous employers and unscrupulous students who are often looking for easy money or at least quick money.
In this context, the National Commission for Protection of Child Rights (NCPCR) intervened. It had come up with the judgment of November 21, 1997, that the placement of children in any employment can only be done with their consent. On January 5, 2019, further to this effect, a private member bill was introduced in Parliament, which aims to amend the Uniform Act for School Students 2017 in a way that comes with a penalty of Rs. 1,000/- per day for non-compliance. On February 11, 2019, Parliament passed this bill as an Act by giving it its law number – BILL NO 59 of 2019 (Laws).
This law has been published in the Gazette and is now applicable in the State of Jammu and Kashmir. It further explains that: The maximum penalty for non-compliance is Rs. 1,000/- per day with a minimum of Rs. 500/- as a fine and does not include any interest on the amount unpaid. Bills introduced by Ministers or by Parliament are considered laws for all purposes unless expressly stated otherwise in this Constitution. The President of India inserted the phrase “Act in camera” in the Constitution Amendment Act, 1951.
Under Article 239(2) of the Constitution of India, a Bill for an amendment to this Constitution shall be introduced in either House of Parliament and passed by each House with a majority vote if it.
(i) is on any one or more provisions of this Constitution and includes any amendment not inconsistent with the provisions of this Constitution, or
(ii) relates to any subject of the Union, except that it shall be for a resolution introduced by Parliament under Article 239(2) the members present and voting in each House.
